In most counties in Texas, divorcing couples are required to attend mediation before their case goes to trial. As a result, most family law attorneys are at least somewhat familiar with the mediation process. However, the mediation process will often determine the outcome of our case, and with so much riding on mediation, you cannot just trust any attorney you need a legal team with experience both in the courtroom and at mediation. At mediation, you and your attorney will attempt to negotiate a final settlement of your case with the help of a mediator. Typically at a mediation, you and your attorney will be present in one room and your spouse will be present with his or her attorney in another room. The mediator's job will be to go back and forth between you and your spouse and attempt to negotiate a settlement of your case.

The process may seem simple enough, but it is critical to be prepared for mediation. If your attorney does not prepare for your case or does not know how your case would likely be resolved in trial, you will not know the value of your case and your will settle blindly, often to your detriment.
